Terms of Service
These Terms of Service ("Terms") govern your access to and use of the WODcomp platform ("Platform").
The Platform is operated by Erik Pach, IČO: 04677102, DIČ: CZ8808191469, registered office at Na Zlaté stoce 1862/9d, 37005 České Budějovice, Česká republika, trading as WODcomp ("we", "us", or "our"), accessible at wodcomp.app and through related services.
By creating an account, registering for an event, creating an event, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform. Where a User is a consumer, these Terms do not affect any rights that cannot be excluded or limited under mandatory provisions of law.
1. Definitions
- Platform: the WODcomp website, web application, and any related services.
- User: any individual who accesses or uses the Platform.
- Athlete: a User who registers to participate in Events as a competitor.
- Organizer: a User or legal entity that creates and manages Events on the Platform.
- Event: a fitness competition or workout event listed on the Platform.
- Registration: the process by which an Athlete signs up to participate in an Event.
- Content: any text, images, videos, data, or other materials submitted to or displayed on the Platform.
2. Eligibility
You must be at least 18 years old to create and hold an account. Accounts are for adults only. A person under 18 may not hold their own account. A legal guardian may register a participant who is under 18 (for example, a junior or teen division competitor) under the guardian's own account. A participant under 18 is a competitor whose personal data we process, but is never an account holder.
By creating an account and accepting these Terms, you confirm that:
- you are at least 18 years old and have the legal capacity to enter into a binding agreement;
- all information you provide is accurate, current, and complete;
- where you register a participant who is under 18, you are their legal guardian (or act with that guardian's authority), you accept these Terms to the extent necessary for the minor's participation in an Event, and you undertake to ensure that the minor's participation is appropriate to their age, health, ability, and the rules of the relevant Event. You also confirm that you are entitled to provide their personal data in the manner described in the Privacy Policy.
3. Accounts
3.1 Registration
To access most features, you must register for an account. You agree to provide accurate and complete information and to keep it up to date. You are responsible for all activity that occurs under your account.
3.2 Credentials
You are responsible for maintaining the confidentiality of your password. Do not share your credentials with anyone. Notify us immediately at support@wodcomp.app if you suspect unauthorised access to your account.
3.3 Account Suspension
We reserve the right to suspend or terminate your account at any time, to restrict access to certain features of the Platform, or to remove specific content, where we reasonably establish or reasonably believe that you have breached these Terms, the law, third-party rights, or the security of the Platform, that you have provided false information, or that you have engaged in conduct harmful to the Platform, other Users, or third parties.
Where we suspend or terminate your account other than for urgent reasons (such as illegal activity, fraud, security threats, or the need to comply with a legal obligation), we will provide you with a statement of reasons and an opportunity to respond before the termination takes effect, where reasonably practicable.
3.4 Account Termination by the User
You may terminate your account through the features of the Platform, where available, or by a request sent to support@wodcomp.app. Termination of an account does not affect obligations already incurred, ongoing Event Registrations, an Organizer's obligations, data retention required by law, or the lawful processing of data described in the Privacy Policy.
4. Use of the Platform
4.1 Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purpose: discovering, registering for, and participating in fitness events, and (for Organizers) creating and managing Events.
4.2 Prohibited Use
You must not:
- use the Platform for any unlawful purpose or in violation of any applicable law;
- submit false, misleading, or fraudulent information;
- impersonate any person or entity;
- attempt to gain unauthorised access to any part of the Platform or to another user's account;
- interfere with, disrupt, or degrade the performance or availability of the Platform;
- scrape, crawl, or extract data from the Platform in bulk without our written permission;
- reverse engineer, decompile, or attempt to extract the source code of the Platform;
- use the Platform to transmit spam, unsolicited communications, or malware;
- resell, sublicence, or commercially exploit any part of the Platform without our written consent;
- post or transmit any content that is defamatory, obscene, hateful, or that violates the rights of any third party.
4.3 Reporting Unlawful or Inappropriate Content
If you believe that content, an Event, or the conduct of a User on the Platform breaches the law, third-party rights, or these Terms, you may contact us at support@wodcomp.app. A report should identify the content or Event concerned with sufficient specificity, describe the reason for the report, include any available supporting material, and provide the reporting party's contact details. We will assess the report in a manner proportionate to the nature of the matter and may take action under these Terms, including restricting display, removing content, or suspending an account.
5. Events and Registrations
5.1 Organizer Responsibility
Events listed on the Platform are created and managed by independent Organizers. We are a technology platform only. We are not the organizer of any Event and are not responsible for the accuracy of Event information, for the conduct of an Event, for its safety arrangements, for judging decisions, for the awarding of prizes, or for any outcomes arising from participation.
5.2 Athlete Participation
By registering for an Event, you enter into a direct agreement with the Organizer of that Event. You must comply with any rules, waivers, or requirements set by the Organizer, as well as with all applicable law. We are not a party to that agreement.
5.3 Physical Activity and Risk
Fitness competitions involve physical activity which carries an inherent risk of injury, health complications, or other harm. By registering for and participating in any Event, you acknowledge and accept those risks. If you have any health problems, limitations, or doubts about the suitability of participating, we strongly encourage you to consult a medical professional before taking part.
WODcomp is not the organizer of Events and, to the extent permitted by applicable law, accepts no liability for any injury, illness, or harm arising in connection with your participation in an Event. Nothing in this Section limits liability for WODcomp or any other liability that cannot be excluded or limited by law.
5.4 Results
Competition results and rankings are managed by Event Organizers. We publish results on behalf of Organizers. Disputes about results must be directed to the Organizer. We have no authority to alter results except at the Organizer's request.
5.5 Organizer Information and Consumer Status
Each Event may state the identity of the Organizer to the extent available on the Platform. The Organizer is responsible for ensuring that information about its identity, contact details, business status, price, participation rules, cancellation terms, and other material circumstances of the Event is complete, accurate, and current. Where the Organizer acts as a business and the Athlete as a consumer, the relevant mandatory consumer protection provisions apply to their direct contractual relationship.
5.6 Event Communications
Communications concerning changes, cancellations, instructions, results, and the practical organisation of an Event take place primarily between the Athlete and the Organizer. WODcomp may provide technical communication tools or deliver an Organizer's notices through the Platform, but does not thereby become responsible for the content of the Organizer's communications or for their fulfilment.
6. Payments and Refunds
6.1 Payment Processing
Payments on the Platform are processed by Stripe, Inc. By making a payment, you acknowledge that the payment transaction is technically processed through Stripe and you agree to Stripe's terms of service (https://stripe.com/legal). We do not store your full card details.
6.2 Fees
Registration fees are set by Event Organizers.
We charge Organizers a platform fee, which is collected from the Organizer's settlement and is not added on top of the price you see at checkout. Where an Organizer chooses to pass platform or payment processing fees on to you, those fees are added to your registration fee and shown in full before you complete your purchase. The total amount payable by you is always displayed before you pay.
6.3 Refunds
Refund policies are set by individual Event Organizers and should be communicated to Athletes before payment is made. We are not responsible for the payment of refunds by an Organizer and have no authority to compel an Organizer to issue a refund.
If you have a refund dispute, contact the Organizer directly. In exceptional circumstances we may assist with settlement or with communication in resolving disputes, but we make no guarantees as to the outcome.
Nothing in this Section affects any statutory rights you may have under applicable consumer protection law, in particular under Act No. 89/2012 Coll., the Civil Code, as amended (the "Civil Code"), Act No. 634/1992 Coll., on Consumer Protection, as amended, and related European Union legislation, including rights under Directive 2011/83/EU of the European Parliament and of the Council of 25.10.2011 on consumer rights (the "Consumer Rights Directive").
Please note that for events taking place on a specific date or within a specific period, the statutory 14-day right of withdrawal from a distance contract (under § 1837(j) of the Civil Code and Article 16(l) of the Consumer Rights Directive) generally does not apply, because the contract relates to leisure activities provided on a specific date. Refunds for such events are therefore governed by the refund policy stated by the Organizer, unless other mandatory consumer rights apply in the particular case.
6.4 Chargebacks
If you initiate a chargeback with your bank or card issuer without first contacting the Organizer or us to resolve the issue, we reserve the right to suspend your account pending resolution of the dispute.
6.5 Complaints Concerning the Platform
Complaints or claims concerning the technical operation of the Platform, your account, the payment interface, or any other Platform Service may be sent to us at support@wodcomp.app. Complaints or claims concerning an Event itself, its cancellation, its conduct, its rules, its results, or a refund of the registration fee should be directed primarily to the relevant Organizer. Where it is apparent from the nature of the matter that the submission concerns the Organizer, we may refer you to the Organizer or pass the submission on to them, where this is proportionate and consistent with the law.
6.6 Out-of-Court Resolution of Consumer Disputes
Where a User is a consumer and a consumer dispute arises between them and WODcomp in relation to the Platform Service which cannot be resolved directly, the consumer may turn to the Czech Trade Inspection Authority (Česká obchodní inspekce), IČO: 00020869, registered office at Štěpánská 796/44, 110 00 Prague 1, web: www.coi.cz, as the body for out-of-court resolution of consumer disputes. This does not affect the rules for disputes between an Athlete and an Organizer, where the responsible contracting party is the relevant Organizer.
7. Organizer Terms
If you use the Platform as an Organizer, you additionally agree to the following:
7.1 Organizer Responsibilities
As an Organizer, you are solely responsible for:
- the accuracy and completeness of Event information;
- obtaining any necessary permits, licences, or insurance for your Events;
- complying with all applicable law, including law relating to health and safety, data protection, and consumer rights;
- handling the personal data of Users and Athletes that you receive through the Platform in accordance with applicable data protection law;
- your own refund and cancellation policies, which must be clearly communicated to participants;
- ensuring adequate safety, health, organisational, and insurance measures appropriate to the nature of the Event;
- fulfilling the tax, accounting, and record-keeping obligations relating to amounts paid for participation in an Event.
7.2 Organizer Payments (Stripe Connect)
Organizers receive payouts through Stripe Connect. You must create and maintain a Stripe connected account and comply with Stripe's terms of service. We collect a platform fee from each transaction as described in Section 7.6 below.
7.3 Event Cancellations
If you cancel an Event, you are responsible for timely and comprehensible communication with participants, for processing any applicable refunds, for fulfilling your obligations towards Athletes as consumers, and for updating the information on the Platform.
We reserve the right to suspend Organizer accounts where an Event cancellation is handled improperly, where Athletes are not treated fairly, or where there is a risk of harm to Users or to WODcomp.
7.4 Prohibited Events
You may not list Events that are illegal, involve prohibited substances, promote discrimination, hatred, or violence, infringe third-party rights, create a disproportionate risk to the health or safety of participants, or otherwise breach the law or these Terms.
7.5 Data Processing
Where WODcomp processes personal data of Event participants on behalf of the Organizer, WODcomp acts as a processor and the Organizer as a controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the "GDPR"). The parties agree to comply with the terms of WODcomp's Data Processing Addendum, which is incorporated into these Terms by reference and is available at wodcomp.app/dpa. As a controller, the Organizer is responsible for ensuring a valid legal basis for processing participant data and for fulfilling all applicable obligations under the GDPR and any other applicable data protection legislation.
7.6 Platform Fee and Invoicing
We provide the Platform to you in exchange for a platform fee (the "Platform Fee").
The Platform Fee is 4% of each athlete transaction processed through your connected Stripe account, inclusive of Czech value added tax (VAT) at the statutory rate.
The Platform Fee is collected automatically at the time of each transaction via Stripe Connect and is deducted from the payment before the remainder is settled to your Stripe account. You receive each transaction amount net of the Platform Fee and net of Stripe's own processing fees. We do not separately bill you for the Platform Fee, as it is deducted at source.
For each calendar month in which Platform Fees were collected, we issue you a tax document summarising those fees and showing the tax base, VAT, and total. The taxable supply date is the last day of the relevant month, and the document is issued on the first day of the following calendar month. Documents are available in your organizer dashboard and are sent to your registered email address.
The Platform Fee is non-refundable. If a registration fee is refunded to an Athlete, the Platform Fee already collected on that transaction is not returned to you.
We may change the Platform Fee. Any change is a modification of these Terms under Section 14, including notice at least 30 days before it takes effect.
7.7 Event Removal, Organizer Restrictions, and Risk Prevention
We reserve the right to refuse to publish an Event, to remove an Event, to restrict its visibility, to suspend registrations, or to restrict an Organizer's account where the Event or the Organizer's conduct breaches these Terms, the law, third-party rights, or the security requirements of the Platform, or where there is a reasonable risk of damage, consumer harm, fraud, or damage to the reputation of the Platform. Where proportionate in the circumstances, we will provide the Organizer with the reason for the measure and an opportunity to remedy it.
7.8 Organizer Tax and Accounting Responsibility
The Organizer is responsible for properly assessing and fulfilling its own tax, accounting, and record-keeping obligations arising from payments received from Athletes, from participation in Events, and from use of the Platform. WODcomp does not provide the Organizer with tax, accounting, or legal advice, and the tax documents issued by WODcomp for Platform Fees do not replace any documents the Organizer may be required to issue to Athletes.
8. Content and Intellectual Property
8.1 Our Content
All content on the Platform that is created by us (including but not limited to text, graphics, logos, software, and design) is the intellectual property of Erik Pach, IČO 04677102, trading as WODcomp, and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or create derivative works from it without our prior written permission.
8.2 Your Content
Ownership of the content you submit to the Platform (such as profile photos, team photos, and event images) remains with you or with the relevant rights holder. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, distribute, and create derivative works from that content (including for formatting, resizing, and other technical purposes) on the Platform and in connection with our services. You represent that you have the rights to grant this licence and that the submitted content does not infringe third-party rights.
8.3 Prohibited Content
You must not submit content that:
- infringes any third party's intellectual property rights;
- is unlawful, defamatory, obscene, harassing, or threatening;
- contains viruses, malware, or other harmful code;
- violates the privacy rights of any individual.
We reserve the right to remove or restrict, without prior notice, any content that breaches these Terms, the law, or third-party rights, or that we consider inappropriate, risky, or harmful to the Platform or to Users. Where proportionate and legally possible, we will inform the User concerned of the reason for the measure.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what personal data we process, why we process it, the legal bases we rely on, to whom we disclose it, and what rights you have as a data subject.
10. Third-Party Services and Links
The Platform integrates with, and may contain links to, third-party services (including Stripe, email providers, and social media platforms). We are not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is governed by their own terms and privacy policies.
11. Disclaimer of Warranties
The Platform is provided "as is" and "as available", without warranty of any kind. To the extent permitted by law, we do not warrant that the Platform will always be available, uninterrupted, error-free, or suitable for a User's particular purpose. This does not affect consumers' rights arising from defective performance or any other rights that cannot be excluded or limited by law.
We do not warrant that:
- the Platform will be uninterrupted, secure, or error-free;
- any defects will be corrected;
- the Platform or its servers are free of viruses or harmful components;
- the content on the Platform is accurate, complete, or reliable.
12. Limitation of Liability
12.1 Athletes (Consumers)
Where you use the Platform as an Athlete in the capacity of a consumer, your rights under applicable consumer protection law remain fully preserved. Nothing in these Terms excludes or limits WODcomp's liability or any other rights of a User acting as a consumer to the extent that such exclusion or limitation would not be permissible under applicable law, in particular under Act No. 89/2012 Coll., the Civil Code, as amended, Act No. 634/1992 Coll., on Consumer Protection, as amended, and the relevant consumer protection legislation of the European Union.
12.2 Organizers (Business Users)
Where you use the Platform as an Organizer acting as a business, we are liable for damage arising in connection with the use of the Platform only to the extent provided by applicable law and by these Terms.
To the fullest extent permitted by applicable law, WODcomp is not liable to an Organizer for any indirect, consequential, special, or similar damage arising out of or in connection with the use of the Platform, in particular loss of profit, loss of data, loss of goodwill, loss of business opportunity, or business interruption.
WODcomp's total aggregate liability to an Organizer for all claims arising from these Terms or in connection with the use of the Platform shall not exceed the total platform fees paid by the Organizer to WODcomp in the twelve (12) months immediately preceding the claim. Where no platform fees were paid in that period, the total aggregate liability shall not exceed EUR 100.
The limitations of liability under this Section do not apply to the extent that they would be impermissible under applicable law.
13. Indemnification
If you use the Platform as an Organizer or as another User acting as a business, you agree to indemnify WODcomp against damage, costs, expenses, third-party claims, and liabilities incurred by WODcomp as a result of, or in connection with:
- your breach of these Terms;
- your breach of applicable law or of third-party rights;
- inaccurate, incomplete, or misleading information you publish through the Platform;
- an Event you create, manage, or offer through the Platform;
- content you submit to the Platform;
- unauthorised or unlawful processing of personal data for which you are responsible as a controller or as another obliged party.
The obligation to indemnify under this Section also covers reasonable costs incurred for legal representation, for dealing with third-party claims, for communication with public authorities, or for defending against asserted claims.
If you use the Platform as a consumer, this Section applies only to the extent permissible under applicable law and may not be construed as imposing a disproportionate obligation on a consumer or as limiting their statutory rights.
14. Modifications to the Platform and Terms
We reserve the right to modify, suspend, or discontinue the Platform or any part of it, in particular for technical, security, commercial, or legal reasons. For changes that materially restrict paid performance already agreed with a consumer, we will proceed in accordance with mandatory provisions of law.
We may update these Terms from time to time, in particular because of changes to the Platform, to the law, to our business model, to security requirements, or to the features provided to Users. We will communicate material changes by email or by a notice on the Platform at least 30 days before they take effect, unless earlier effect is required by law or by an urgent security reason. If you do not agree to the updated Terms, you may terminate your account before the changes take effect by contacting us at support@wodcomp.app. Your continued use of the Platform after the changes take effect constitutes your acceptance of the updated Terms.
15. Termination
We may suspend or terminate your access to the Platform, in particular in the event of a breach of these Terms, a breach of the law, a security risk, fraud, misuse of the Platform, account inactivity, or discontinuation of the Platform. Where proportionate and legally possible, we will inform you of the reason for, and the effects of, the termination or suspension.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers of warranties, limitation of liability, and indemnification) shall survive.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Czech Republic, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If it is not resolved within 30 days, disputes shall be submitted to the competent courts of the Czech Republic. Where a User is a consumer, this does not affect their right to bring proceedings before the court having jurisdiction under mandatory procedural law, nor their right to use out-of-court resolution of a consumer dispute.
17. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms to the extent caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic, war, terrorism, governmental action, power outages, or Internet infrastructure failures. We will notify you as soon as reasonably practicable of any such event affecting our ability to provide the Platform.
18. General
- Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and Erik Pach, IČO: 04677102, DIČ: CZ8808191469, registered office at Na Zlaté stoce 1862/9d, 37005 České Budějovice, Česká republika, trading as WODcomp, regarding the Platform and supersede all prior agreements.
- Severability: if any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force.
- Waiver: our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: you may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
- No third-party beneficiaries: these Terms do not confer any rights on third parties.
